Terms of Service

These Terms of Service govern your use of Shayr, our website located at shayrapp.com, and any related services provided by Shayr. When you create a Shayr account or use Shayr, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations.

If you access or download Shayr from (1) the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service; and/or (2) the Google Play Store, you agree to the Android, Google Inc. Terms and Conditions. We reserve the right to amend these Terms at our sole discretion, effective immediately upon publication.

Limitations of Use

By using Shayr, you agree that you will not:

• Modify, copy, decompile, or reverse engineer Shayr or any of its materials
• Remove any copyright or proprietary notations from Shayr
• Transfer Shayr or mirror its materials on any other server
• Use Shayr in a way that abuses or disrupts our networks or services
• Transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material
• Use Shayr to send unauthorized advertising or spam
• Harvest, collect, or gather user data without consent
• Infringe the privacy or intellectual property rights of any third party

Intellectual Property

The intellectual property in the materials in Shayr and on our website are owned by or licensed to Shayr. You are granted a personal, non-exclusive, non-transferable license to use the app on your mobile device for personal use only. The app is licensed, not sold.

User-Generated Content

You retain your intellectual property ownership rights over content you submit to us. We will never claim ownership of your content, but we do require a license from you to use it. You may terminate this license at any time by deleting your content or account.

Net Worth and Financial Data Tracking

Shayr offers tools including net worth tracking, transaction aggregation, and expense categorization. These features are for informational purposes only. Shayr relies on information provided by third-party institutions and the accuracy of data may vary. Users are responsible for verifying financial information displayed and for any decisions made based on that information. Shayr does not offer financial, investment, or legal advice.

Transactions and Account Linking

By linking accounts, you authorize Shayr to access and retrieve financial information from third-party institutions on your behalf. The security of account credentials remains your responsibility. This service is intended solely for personal and non-commercial use.

Limitation of Liability

Shayr's services are provided on an "as-is" and "as-available" basis. To the extent permitted by law, Shayr makes no warranties regarding performance, availability, or suitability for any particular purpose. In no event shall Shayr be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use our services.

Subscriptions and In-App Purchases

Shayr offers optional paid subscription plans ("Bussin" and "GOAT") that unlock premium features. Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription in your device's account settings. No refund is provided for the unused portion of a current subscription period, except where required by applicable law. A free trial period, if offered, begins at the time of account creation. Any unused portion of a free trial is forfeited upon purchasing a subscription.

Notice Regarding Apple

These Terms of Service constitute an end user license agreement ("EULA") between you and Shayr only, not with Apple Inc. ("Apple"). Apple is not responsible for Shayr and has no obligation to furnish any maintenance or support services with respect to Shayr.

In the event of any failure of Shayr to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Shayr to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Shayr.

Shayr, not Apple, is responsible for addressing any claims you or any third party have relating to Shayr or your possession and/or use of Shayr, including: (i) product liability claims; (ii) any claim that Shayr fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that Shayr or your possession and use of Shayr infringes that third party's intellectual property rights, Shayr, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

Indemnification

You agree to indemnify, defend, and hold harmless Shayr and its affiliates from any third-party claims, liabilities, damages, or legal expenses arising out of your use of Shayr, breach of these Terms, or infringement of any third-party rights.

Termination

Shayr reserves the right to modify, suspend, or terminate any aspect of its services at any time. Termination may result in loss of data associated with your account. Shayr is not responsible for storing or preserving user data after termination.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States. You irrevocably submit to the exclusive jurisdiction of the courts in the United States.
